The Convention for Self-discipline of China Cleaning Industry
Chapter 1 General Principles
Article 1, the Convention was formulated in accordance with relevant Chinese
laws, decrees and the actual situation of China cleaning industry to set up the
self-discipline mechanism of China cleaning industry, regulate the behaviors of
industry participants, safeguard fair and orderly competition to protect
legitimate rights of business operators, promote credit construction in China
cleaning industry and drive sustainable development of cleaning industry.
Article 2, the Convention shall be performed by members of China Cleaning
Industry Association, and other organizations engaged in design, R&D,
production, equipment manufacturing, packaging, purchasing, sales, education,
testing and other activities in the cleaning industry and the sectors along the
value chain of cleaning products.
Article 3, China Cleaning Industry Association acts as the supervision body
of the Convention, taking the charge of regulating and supervising the
implementation of the Convention.
Article 4, members shall pursue the principle of integrity and abiding by
law, conscientiously safeguard the market order of cleaning industry in China,
and abide fully by Product Quality Law of the People’s Republic of China, Price
Law of the People’s Republic of China, Law of the PRC against Unfair
Competition, Law of the PRC on Protecting Consumers’ Rights and Interests, Standardization Law of the People’s Republic of China and relevant laws and
regulations to make sure law-abiding production and operation.
Chapter 2 Main Provisions
Article 5, complying
with social and professional ethics, safeguarding public interests and order, protecting
enterprises’ long-term interests and reputation, meeting consumer demand and
protecting consumers’ rights and interests.
Article 6,
advocating unity and coordination and mutual support, drawing on each other’s
strength among cleaning industry participants. Addressing and resolving hot and
difficult issues by exchanging information and discussing friendly together to
facilitate healthy development of cleaning industry.
Article 7,
abiding by the principle of integrity and business morality, observing industry
guiding rules and principles, participating in open, fair, just and orderly
market competition. Members shall not violate the interests of other
enterprises by raising prices willfully, cutting prices for competition or
using other was; fabricate or spread fake facts to hurt business and product
reputation of business rivals; stir and participate unfair competition
illegally.
Article 8,
continuing the guideline of scientific development and independent innovation
to strengthen the development of science and technology and circular economy;
actively promoting new processes, equipment, materials and technologies;
emphasizing environment protection, safety and energy saving and emission
reduction; raising low-carbon economy awareness; promoting industry structure
adjustment to follow the trend of producing concentrated liquid products;
shouldering the responsibility on safe production, environment protection and
safety in accordance with China laws.
Article 9,
putting quality first and focusing on brands, standards, service and
performance to improve quality management systems; strengthening the market
oversight and credibility systems; organizing production strictly according to
product standards and processes; strengthening social responsibility.
Article 10, cleaning product enterprises shall honor credit and
contract during business association and operation. Commercial trick and fraud
are prohibited.
Article 11,
maintaining orderly flow of talents in cleaning industry. When hiring new
employees, members shall respect legitimate rights and interests of the
organizations the new employees have served for and shall not acquire and apply
technological achievements, intellectual property right and business secret of
the organizations illegally.
Article 12, safeguarding legitimate rights and interests of laborers
in accordance with state and territory regulations. Strengthening law, discipline
and professional education, encouraging education of politics, science,
technology and professional knowledge, improving moral cultivation and
professional quality of staff and encouraging diligence and dedication.
Chapter 3 Convention Management
Article 13, the Self-discipline Convention is the most fundamental
production and operation rules regulating cleaning industry and enterprises,
which should conscientiously accept the supervision and criticism of people of
all sectors, and join hands to curb and correct irregular practices in the
industry.
Article 14, any violation of the Convention causing an adverse effect will
be given either disciplinary warning or industry internal criticism or
circulating a notice of criticism or press coverage considering different
situations. Violators will be punished by relevant national law enforcement
authority.
Article 15, any imperfection found during the implementation can be
proposed by members for revision, which will be approved after discussion in the
China Cleaning Industry Association council meeting.
Article 16, the Convention is revised on the basis of “CCIA Self-discipline
Convention” approved by the forth session of the fifth council meeting of CCIA
on November 11, 2004, and deliberated and approved in the third session of the
sixth council meeting of CCIA on November 11, 2010.
Article 17, CCIA council meeting owns the right of interpreting the
Convention.
Article 18, the Convention will take effect immediately once approved.
China Cleaning Industry Professional Ethics Code
Article 1, China Cleaning Industry Professional Ethics Code (hereinafter
referred to as the Code) was formulated based on CCIA charter to strengthen
moral and ethical education, regulate industry behavior, strengthen industry
self-discipline, safeguard the rights and interests of participants, protect
legitimate rights and interests of enterprise, enhance professional ethic level
of industry practitioners, improve China cleaning industry level and
competitiveness.
Article 2, the Code shall be applicable to CCIA members, as well as other
enterprises and organizations dedicated to design, research and development,
production, marketing in the fields of cleaning products, professional
additives, surfactants, oleochemicals, equipment, package, education and
testing.
Article 3, China Cleaning Industry Association shall be responsible for the
formulation, modification and implementation of the Code, and associated
supervision, examination and management.
Article 4, working passionately and dedicatedly, making contribution to the
society. The practitioners shall attach great importance to taking social
responsibility and follow the principle of collectivism to establish strong
sense of dedication and responsibility, devote themselves to their duty, take
initiative to safeguard the reputation of enterprise and the industry they
serve, and improve their professional quality and competence so as to reflect
their self social value while creating economic benefits and realizing social
benefits for enterprises.
Article 5, abiding by the law. The practitioners shall fully and strictly
implement national laws and enterprise rules, act in compliance with law, and
make sure all the missions and duties fulfilled.
Article 6, setting credibility and service as the essence of business. The
practitioners shall adhere to fair trade principle, honor contract and
credibility, establish the strong sense of putting customers first, provide
sincere and high-quality service to customers, refuse the act of fraud and
damage of customers’ interests, and build up good corporate image.
Article 7, valuing quality. Keep strict control of production management,
actively carry out relevant technical standards, strive to pursue top-notch
service, quality and reputation, keep strict control of material quality and
refuse shoddy products.
Article 8, developing innovatively. The practitioners shall establish
comprehensive sense of innovation, including innovation on thinking, concept,
system, operating mechanism, technology, culture and service, put emphasis on
learning and applying new technology, method and process, and continue to
optimize design and product.
Article 9, focusing on environmental protection. Make great efforts to
develop science and technology and recycled economy, actively promote new
process, equipment, material and technology, pay attention to environmental
protection, safety, energy saving and emission reduction, strengthen low-carbon
economy sense, facilitate resource saving and clean production, and strive hard
to promote sustainable development of cleaning industry.
Article 10, unity and coordination. Enterprises shall strengthen
communication, information and experience exchange, and expand cooperation under
the premise of respecting intellectual property right, jointly protect and give
full play to the overall advantage of the industry, and create an atmosphere of
unity, coordination and joint advancement.
Article 11, focusing on people. Enterprises shall fully protect and give
play to the production enthusiasm of staff, encourage technical innovation and
reasonable proposals, emphasize talent cultivation, actively carry out technical
training and communication and employee education, build corporate culture and
spirit, and continue to improve overall quality and professional ethics of
employees.
Article 12, the Code was deliberated and approved in the second session of
the sixth CCIA Congress on November 9, 2011.
Article 13, CCIA council meeting owns the right of interpreting the
Code.
Article14, the Code will take effect immediately once approved.
China Cleaning Industry Dispute Settlement Rules
Article 1, the Rules was formulated to strengthen industry self-discipline
and maintain the steady, harmonized and sustainable development of cleaning
industry.
Article 2, the Rules is applicable to the settlement of disputes rising
between China Cleaning Industry Association (hereinafter referred to as CCIA)
members, or between CCIA members and other cleaning industry enterprises.
Article 3, members shall fully understand and conscientiously abide by the
Rules.
Article 4, disputes arising out of or in connection with the implementation
of self-discipline convention shall be submitted to CCIA for settlement.
Article 5, disputes between CCIA members shall be resolved through friendly
negotiation by the parties beholding the principle of mutual understanding and
accommodation.
Article 6, CCIA shall communicate relevant laws, regulations, policies and
information of self-discipline to members, reflect the opinions and requirements
of members and provide timely investigation and research over significant
disputes rising in cleaning industry, and resolve through the ways as below:
1. reconcile the two parties concerned;
2. organize experts to make a conclusion, provide opinions and settle
disputes based on experts’ opinions.
3. the opinions may include criticism and education, internal notification,
public notification, membership cancellation and suggest government to give
punishment.
Article 7, in case no settlement can be reached, the disputes in question
shall be submitted for arbitration in compliance with law.
Article 8, the Rules was deliberated and approved in the second session of
the sixth CCIA Congress on November 9, 2011.
Article 9, CCIA council meeting owns the right of interpreting the
Rules.
Article 10, the Rules will take effect immediately once approved.
The Disciplinary System on China Cleaning Industry Self-discipline
Article 1, the System was formulated to regulate self-discipline management
in China cleaning industry, strengthen the supervision of China Cleaning
Industry Association (hereinafter referred to as CCIA) and drive healthy and
steady development of the industry.
Article 2, the System shall be applicable to CCIA members, as well as other
enterprises and organizations dedicated to design, research and development,
production, marketing in the fields of cleaning products, professional
additives, surfactants, oleochemicals, equipment, package, education and
testing.
Article 3, the party who fails to perform CCIA Charter and Self-discipline
Convention, damage the reputation and development of industry and cause serious
consequence, will get punished. The CCIA council meeting will decide whether or
not take disciplinary action. After the closing of council meeting, the
president working meeting will make decision and send a written document to the
party concerned.
Article 4, the following ways can be adopted to give a punishment:
1. Internal warning;
2. Charging correction and review in written form;
3. Circulating criticism inside the industry;
4. Filing digitally;
5. Publish in CCIA official website;
6. Cancelling membership;
7. In case suspicion of engaging in unlawful activity, the case will be
submitted to government and judiciary authorities.
Article 5, whoever subject of punishment will get lesser or exempt from
punishment in one of the following cases:
1. take the initiative to correct before investigation;
2. take the initiative to eradicate or alleviate irregularities and the
harm consequences;
3. actively cooperate with CCIA to investigate irregularities and take the
initiative to make correction;
4. take the initiative to report irregularities to CCIA.
Article 6, the System was deliberated and approved in the second session of
the sixth CCIA Congress on November 9, 2011.
Article 7, CCIA council meeting owns the right of interpreting the
System.
Article 8, the System will take effect immediately once approved.
